DLA Piper Africa, Botswana (Minchin & Kelly) advises Smart Partnership Enterprises on the construction and development of Botswana’s newest retail precinct, The Fields Mall

By Terence Dambe

DLA Piper Africa, Botswana (Minchin & Kelly) is proud to have advised Smart Partnership Enterprises (SPE) on the construction and development of the Fields Mall, a retail centre with a gross lettable area of 26,000m2, located in the Central Business District of Botswana’s capital, Gaborone.

On 28 July 2022, Smart Partnership Enterprises (SPE), the proprietor of a 9-hectare piece of land, officially opened the doors of the Fields Mall. SPE shareholders raised over USD 30 million to fund the development of the centre, which is the second phase of the entire proposed mixed-use development, the first phase being an office block which was completed in 2018.

DLA Piper Africa, Botswana acted for SPE providing the full spectrum of legal services necessary for the acquisition of the land, creation of the sectional title scheme and development of the Mall. Planning permission for the future development of more offices, a hotel and apartments, has been duly granted by the planning authorities. Upon completion, the Fields Precinct will be the largest mixed-use sectional title scheme in Botswana.

Managing Partner, Terence Dambe said: “It has been a challenging but greatly fulfilling experience working on this exciting project which will no doubt further stimulate Botswana’s growing retail sector. Our multi-disciplinary team of lawyers has worked hand in hand with our client’s board and management team throughout the project and we look forward to working together on future development phases in the Fields Precinct.”
