James Mukasa Sebugenyi (SC) is a senior counsel and experienced advocate in Uganda. He has handled a wide range of litigation and arbitration matters across key sectors, including commercial and corporate law, real estate, product liability, constitutional law, property fraud, telecommunications, energy, expropriated properties, utilities, employee benefits, and aviation negligence.
James serves on the boards of a mining company, an insurance company, and a resort hotel and golf club, where he is actively involved in governance at the board level.
He served as President of the Uganda Law Society from 2011 to 2013, was a member of the Law Council between 2010 and 2013, and later sat on the Management Committee of the Law Development Centre from 2014 to 2016.
He has participated in numerous seminars and conferences around the globe as a speaker and faculty on litigation practice. In 2009, James was attached to Kirton & McConkie Attorneys, Utah, Salt Lake City, USA as Visiting and Training Attorney. He has served as a trial advocacy trainer under the Justice Advocacy Africa cohort from 2014 todate.
Experience has included advising:
- MTN Uganda for its USD150 million initial public offer - the first telecommunications sector public offer in Uganda; the largest ever public offer in the history of the Ugandan capital markets; the first public offer to utilise digital channels (including mobile money) and the largest public offer in Africa in 2021.
- AMEA Power for the establishment of a 20MW solar power facility, including special-case licensing approvals and project financing.
- Pearl Development Group in the establishment of the Lake Victoria Serena Hotel, Spa and Golf Club. This involved land acquisition advisory, obtaining relevant permits and government approvals as well as resolution of disputes related to the property.
- National Environment Management Authority in appellate proceedings before the Court of Appeal to challenge a US$ 50 million damages award to a former licensee following the statutory cancellation of the former licensee’s sand-mining license.
- Uganda Breweries [Diageo] in relation to an environmental pollution complaint lodged before the Equal Opportunities Commission as a result of brewing plant emissions and negotiated a successful settlement.
- TotalEnergies E&P in a public interest claim that challenged the company’s procurement process for the development of the US$ 5 billion Tilenga oil field.
- Uganda Civil Aviation Authority on various matters including representation in the High Court, Court of Appeal and Supreme Court of Uganda in matters relating to aviation negligence, statutory obligations and compliance with International standards.
