Japheth Mutisya is an Associate in the Projects, Energy, and Restructuring practice group at the firm. He advises on a wide range of matters in the energy and infrastructure sectors, and in public-private partnerships (PPP). His expertise includes conducting compliance reviews, legal due diligence, feasibility studies, drafting and negotiating transaction agreements, issuing legal opinions, and engaging regulators.
As part of the team, Japheth has experience working with diverse clients, including government entities, private sector players, and multinational corporations. He advises on complex projects aimed at fostering sustainable development and is skilled at navigating Kenya's legal and regulatory landscape, with a focus on aligning projects with local and international standards. Through his work, Japheth supports clients in achieving innovative energy solutions, efficient infrastructure development, and successful PPP initiatives.
Experience has included advising:
- As part of a team, KenGen on the development of the world’s first geothermal powered green fertilizer manufacturing plant in Kenya.
- As part of transaction advisory teams, the Government of Kenya in connection with various health PPP projects, including the Moi Teaching and Referral Hospital College of Health Sciences Project, the Pwani University Teaching, Research and Referral Hospital Project, and a project for the development of a 50-bed cancer facility at Meru Teaching and Referral Hospital and four satellite clinics.
- As part of a team, KenGen on the establishment, structuring, operationalization, and investor onboarding framework for a world class green energy industrial zone which shall incorporate access to 100% renewable energy, logistics infrastructure, transport networks and providing an enabling environment to foster the green economy.
- As part of a team, advising a client on the acquisition of the share capital of an SPV developing a 40 MW solar energy project in Kericho County.
- Generally on complex energy and infrastructure transactions involving project structuring, regulatory compliance, project agreements, negotiations, and project development matters within Kenya’s energy sector.
