José Roque Gonçalves

José Roque Gonçalves is the partner in charge of the litigation practice at SAL & Caldeira. He regularly appears in court (in the Supreme Court and Provincial and District Courts and Administrative Court) on behalf of clients in both the private and public sectors as well as international institutions. He assists national and foreign clients in court in civil, labour, commercial, maritime, criminal matters and in matters of debt collection. He is also active in the resolution of conflicts through mediation and arbitration.

Experience has included advising:

  • On judicial processes for debt collection representing the some of the main commercial banks in Mozambique
  • On revision and confirmation of foreign judicial and arbitration awards processes mostly filed by our foreign clients 
    In the insolvency process of a large company based in the Nampula province
  • In a judicial recovery process of a large company based in Tete province
  • In a judicial recovery process of a large company based in Maputo province
  • In labor processes of large companies and non-governmental organizations running terms before several Mozambican courts
  • In judicial processes of large companies related to property disputes
  • Clients' seizure processes running terms before the Mozambican courts  
  • On judicial processes for public administration acts annulments before Mozambican administrative courts
  • In criminal proceedings involving theft and documents falsification running terms before the Mozambican courts

Legal implications for procedural acts during the state of emergency

By Presidential Decree no. 11/2020, of 30 March, the President of the Republic of Mozambique decreed the State of Emergency, on grounds of public calamity, throughout the country, with a duration of 30 days, effective as from 0.00 a.m. on 01 April 2020 and ending at 24.00 a.m. on 30 April 2020.
