Employee and Labor Relations

Our lawyers have years of experience in dealing with collective relations and traditional labor matters and disputes. We are ideally placed to advise, guide and represent employers in Mozambique and beyond.

Whether employers are focused domestically or globally, the laws relating to an employer’s relations with its workforce are becoming increasingly critical and central to corporate strategy.

Our employment lawyers are well-known for their expertise in the resolution of collective disputes and assistance in the resolution of strikes. We also help our clients with employee negotiations, whether unionized or not, and draft collective labor regulation.

Capabilities

Disciplinary Proceedings: We provide advisory services, by conducting prior enquiries and preparing and initiating disciplinary proceedings. In particular, we draft notices of accusation, submit disciplinary proceedings to trade unions, conduct investigations that may result from disciplinary proceedings, hold employee and witness hearings, and draft reports and proposals as regards to the final decisions.

Individual and Collective Negotiations: Our employment lawyers are well-known for their expertise in the termination of employment contracts with senior employees and/or their lawyers, resolution of collective disputes, assistance in the resolution of strikes, and negotiation and drafting of collective labor regulation instruments.

Experience has included advising:

  • A large mining company during a strike.
  • An international aviation company, in a process of negotiation and drafting of a collective bargaining agreement.
  • A private sector business association with the process of minimum wage negotiations, involving the union and the government.
  • A large mining company, in the process of mediation of a collective dispute.
