Banking and Finance Litigation

In the aftermath of the global financial crisis and the more recent accusations regarding LIBOR and foreign currency exchanges, banks and other financial institutions need now, more than ever, to reduce and manage legal, regulatory, financial and reputational risks.

We are experienced in handling large and complex investigations and claims and are regularly instructed by large financial institutions in relation to their most substantial and sensitive disputes.

Capabilities

  • Large claims
  • Complex investigations

Experience has included advising:

  • A consortium of local bankers in insolvency proceeding against an agriculture company for the recovery of USD15 million
  • A regional banking client in insolvency proceedings against a mining entity in the Chrome sector for the recovery of a debt in the sum of USD12 million, culminating in a restructuring plan by the creditors.
  • A financial institution before the Arbitration Foundation of Southern Africa (AFSA) in its defending claims amounting to approximately US$6 million.
