Limited term for submission of complaints

On late internal debt during the economic exercises of 2013 to 2017

Executive Decree No. 507/18 of 20 of November established that complaints must be submitted no later than January 31, 2019. 

Complaints must be submitted to the Budget Units that have contracted debts, accompanied by the following documents:

  • Current account presented in a template to be provided by the Budget Unit;
  • Public Contracts;
  • Invoices;
  • Terms of delivery of goods and services;
  • Measuring instruments, when necessary;
  • Notes of the reserve fund;
  • Other relevant documents.

All claims to be submitted are subject to the independent audit and the current Debt Certification procedure.

Failure to present the claim under the terms and within the period established shall discharge the State of any obligation to creditors whose execution of the expenditure has not been carried out under the current budgetary legislation.

Limit Term for the Provision of Information to the State on the existence of Public Guarantees on Internal and External Debts (Sovereign Guarantees) that have been issued in accordance with law

All national and foreign entities that are beneficiaries of Sovereign State Guarantees on credits contracted or granted by them are subject to the application of Executive Decree no. 508/18 of 20 November.

The Diploma considers as Guarantee, the letters and instruments of Sovereign Guarantee valid and legally authorized and issued by the State, through the Ministry of Finance, under the terms of the Law.

The Diploma considers as Beneficiaries banking entities, financial institutions and others in favor of which the Sovereign Guarantee has been issued, as well as the public and private entities that are liable for secured credits.

The information must be sent to the Public Debt Management Unit of the Ministry of Finance until 31 January 2019 and must be accompanied by the following documents:

  • Copy of the Sovereign Guarantee;
  • Loan / financing agreement and respective addenda, if any;
  • Financing plan and degree of credit execution;
  • Proper form filled out;
  • Other relevant documents.
